Accommodations and Leaves for COVID-19

Accommodations for COVID-19

Under the Americans with Disabilities Act (ADA) and/or under the governor’s current order regarding “Vulnerable Individuals,” you may qualify for an accommodation. Individuals who could qualify for an accommodation include those who:

  • Are 65 years and older

  • Have chronic lung disease or moderate to severe asthma

  • Have serious heart conditions

  • Are immunocompromised

  • Are pregnant women

  • Are determined to be high risk by a licensed health care provider

  • Other individuals with a recognized disability that interferes with their ability to perform the essential functions of their job during the COVID-19 pandemic.

Potential accommodations for employees who fall into these categories include:

  • Working remotely (in your current placement or in a different placement working with students who choose a full-time remote option in the fall).

  • Working in-person, but with increased safety measures to protect the health of the employee.

  • Note: These are only examples. The accommodations that can be made in your case may depend on the nature of your disability or Vulnerable Individual status, your job duties, your work location and other factors.

Submit the Form by July 31

Starting in July, district teams will build staffing and student schedules for schools. In order to have sufficient time to plan for our first day of school, employees are asked to please fill out this secure and confidential form for Human Resources by July 31. It will be reviewed by the HR Leave team. No action is required if you are not seeking an accommodation.

The form will ask you for information about your current position, which will be used to help develop accommodations. The form will also ask you to provide medical documentation regarding your disability or the reasons you qualify as a Vulnerable Individual. No documentation is required for a request based on age.

Note: Although it is critical for planning that we have requests by July 31, this process and our traditional ADA process will remain open for accommodations all year.

Leave for COVID-19

Under the CARES Act, employees are eligible for a leave of absence if:

  • You have tested Positive for COVID-19

  • A member of your household has tested positive for COVID-19

  • You have lost childcare due to COVID-19 closures (including school closures)

Please Note: This is an evolving situation.  All changes are updated on this page as they occur.  Visit the US Department of Labor or the Colorado Department of Labor for even more information on COVID-19 related leaves for employees.

Frequently Asked Questions

Will my manager/administrator receive confidential details about my request?

No.  Your manager/administrator will know that you asked for an accommodation, and whether it was apprived as a valid medical request.  However, they will not receive any details regarding your medical situation or other confidential information in your request.

Is my job in jeopardy if I make an accommodation request?

No. By requesting a COVID accommodation, your job is not in jeopardy.  You are protected under the CARES Act and D60 policy.  We cannot guarantee an accommodation; however, Pueblo School District 60 is making every effort to work through all requests as quickly as possible and provide accommodations where we can.

Am I "locked-in" to an accommodation solution?

No.  Where possible, D60 will offer accommodations.  You will have the ability to accept or deny your specific accommodation proposal.  You will be involved in making the decisions for your accommodation and D60 will make every possible effort for an accommodation that suits your situation.

If your needs for accommodation change during your accommodation period, please contact your supervisor to discuss and determine if changes are possible at that time.  We cannot guarantee that changes to your accommodation will be available.

What if the district can't fulfill my accommodation request?

We will make every effort to approve accommodations, but we cannot guarantee approval.  The district will prioritize requests for vulnerable individuals and those with disabilities.  All D60 employees are expected to work in-building unless your accommodation request is approved.  If your accommodation request is denied, you may still have the option for Leave of Absence under the CARES Act.

If my supervisor has said our whole team is staying remote, do I still need to submit an accommodation request?

No.  In this case, you do not need to submit an accommodation request.  You would only need to submit a request if your supervisor informs you of a return to work schedule and you still need an accommodation.
